A Deal Is A Contract

I am not an attorney but I have dealt with business contracts quite a bit. Often though, one party or the other does not understand or realize they have entered a contract with another party, mostly because the contract is verbal. Verbal contracts are usually called deals and both parties are expected to live up to the agreement.

We have contracts so both parties know what their responsibilities are. Often one side cannot meet their obligations under the contract and we call that a breach. What should the other party do in this case?

They could try to work out a contract separation agreement. Perhaps the jilted party can agree to a monetary settlement that works for them. Often the party that breached the contract cannot settle in this way because they had a financial setback that caused them to breach in the first place.

They could take the issue to court. Perhaps a judge can create some sort of settlement that works for both parties.

They could allow the other party out of the contract. Sometimes there is no real damage involved, but this depends on how much the parties have invested into the contract in terms of time and or money. If this is something that happened just after a contract was entered into, perhaps just going separate ways is a good idea.

Remember that a deal that both parties agree to is a contract, even before the signature is on the page. Business people know this and assume that they are dealing with others in good faith. When this is not the case, it can lead to tremendous losses. How can you be sure that a contract is actually a contract?

Get it in writing. The easiest way to litigate a contract is if the terms are spelled out, agreed to, and signed on the dotted line. Make sure the wording is clear so that both parties can understand.

Spell out the consequences. If either party breaches on the contract, what are the consequences? Spell it out in the contract so that both parties understand.

When you decide not to use the nuclear option when the other party does not live up to the contract, what are the consequences to your business? That is the question you must answer if you decide to walk away.

The Trans-Pacific Partnership (TPP) is a proposed trade agreement formerly among 12 countries that was intended to strengthen economic relationships among these countries by eliminating tariffs and promoting free trade. The twelve countries involved in signing the TPP proposal on February 4, 2016, were Canada, Japan, Australia, Mexico, Vietnam, Singapore, Brunei, Malaysia, New Zealand, Chile, the United States, and Peru. Donald Trump's executive order to remove the U.S. from the TPP on January 23,2107, was a serious mistake. Trump withdrew the U.S. from the TPP with intentions of improving the growth of U.S. jobs and restoring the deteriorating manufacturing industry. He believes that the TPP is detrimental to U.S. employees and the manufacturing industry because an enormous amount of U.S. jobs would be exported to low-wage nations. Many U.S. companies outsource jobs to other countries in order to capitalize on cheaper operational and labor costs. Even though Trump's decision promotes the growth of jobs in the U.S., it will be more harmful in the long-term because it will be difficult for the U.S. to sustain its influence and leadership in international economic and political affairs. Also, China would be in a position to take advantage of the U.S.'s withdrawal from the TPP and become a dominant country in the global economy. Therefore, Trump's decision will be more detrimental than beneficial for the U.S.'s economy.

By resigning from the TPP, the U.S. loses a huge opportunity to expand their markets, eliminate tariffs, and promote exports. The TPP would have been the largest free trade deal in history because the countries involved control an annual gross domestic product (GDP) of roughly $28 trillion, which represents approximately 40 percent of the global GDP and one-third of world trade. Implementing the TPP would have tremendously improved international trade relationships between the original countries involved, which would have been far more beneficial for the U.S. than Trump's plan to increase homeland job security. Fortunately for the U.S., immediate penalties to international trade flows have not occurred from their decision to withdraw from the TPP because they still maintain existing free trade agreements with six of the TPP countries (Mexico, Chile, Singapore, Australia, Canada, and Peru). However, Trump's decision will place the U.S. at risk for economic and political disaster in the near future.

As a result of Trump's decision, China was granted a huge opportunity to surpass the U.S. and become the dominant country in the global trade economy. Chinese President, Xi Jinping, plans to take advantage of Trump's foolish decision in order to improve China's relationships with several of the other countries involved in the TPP. China intends to negotiate a new free trade agreement with several of the original countries involved in the TPP and other neighboring Asian countries. The new free trade agreement in proposal is called the Regional Comprehensive Economic Partnership (RCEP), and it would include 16 Asia-Pacific countries. Similar to the TPP, the RCEP intends to promote free trade by eliminating tariffs and strengthening economic relationships among the countries involved. If the RCEP is successfully implemented, then China will be in as strong position to create the guidelines of

Many Asia-Pacific countries invested a tremendous amount of political capital into a U.S. led trade deal that was not administered. Therefore, since the U.S. was unable to commit to the TPP, their reputation and credibility is undermined considerably. This will be a disaster for the U.S. economy because they will lose the majority of their influence in the Asia-Pacific region. Many countries in both Asia and Latin America already view China as the superior and more reliable country in the global trade economy than the U.S. These countries prefer to negotiate trade agreements with China because it is hard for them to trust the U.S. The U.S. should be the dominant country in the global trade economy, not China. Trump is leading the U.S. towards failure because he should have realized sooner that his decisions would lead to devastating consequences for the U.S.'s economy. The U.S. should have seized their opportunity to claim an authoritative position and create the guidelines for the global economy, instead of handing it over to China. In the future, it will be difficult for the U.S. to negotiate favorable trade conditions and access the Asian supply chain because strong economic relationships will be established between China and the majority of the Asia-Pacific countries.

In recent years, the Middle East (particularly the Gulf Corporation Council (GCC)) has become a magnet for international companies in pursuit of growth opportunities due to internal and external factors. Within the Middle East, mass investments have been made across all industry sectors, including healthcare, transportation and real estate. Furthermore, the Middle East has seen changes such as the deregulation of State-owned monopolies and the privatization of government-owned companies. Pursuing business in the Middle East may feel like you are taking a big leap, as the business culture is very different to that of the West. However, this is true of conducting business in any other continent and an appreciation of how things operate will make the experience both exciting and rewarding. It is worth mentioning that connections, whether they are through business or family, are vital when conducting business in the Middle East. This further highlights the need for having a partner who is already well established in the region.

Self-Leadership Challenge 6: The "Secret Sauce" of Powerful Executive Presence

What is Executive Presence? I have found a lot of confusion among executive coaching clients about the true meaning of this "buzz phrase." The way I like to define it is: "a set of attitudes, behaviors, and skills which-when combined-send the right signals, influence others, and ultimately drive results."

If you're a senior leader, you no doubt already have some degree of Executive Presence. It's how you've reached your current level in the first place. The most admired people have Executive Presence in abundance-people like Nelson Mandela, Oprah Winfrey, and Richard Branson, to name a few. You know when you've met someone with powerful Presence. You feel drawn to that person and you want to connect with him or her.

"But can you learn Executive Presence?" clients ask? Yes. And doing so improves your self-leadership, strengthens your executive leadership brand, and helps you advance in your career. Want proof about how important it is? According to a study of 236 senior executives, who make decisions about promotions within their organizations, Executive Presence accounts for more than one-quarter of what they look for in someone who is aiming to reach the next level. Many similar studies exist, all pointing to one outcome: Executive Presence is fundamental for those who want to reach increasingly higher levels in any organization. So, what can you do to develop powerful Executive Presence? What's the "secret sauce"?

The Most Important Ingredient of the "Secret Sauce"

I believe that underlying every aspect of Executive Presence is one core element: confidence-the absolute certainty that you can do what it takes to succeed in any situation. When you have confidence, you believe in yourself, so that-even if you're undertaking something new-you know you'll be able to figure it out when you get there.

Yet, many accomplished leaders lack the confidence they need to cultivate strong Executive Presence. One indication of that: I've met a large number of leaders who suffer from the "Impostor Syndrome." That's a term which describes high-achieving people who don't really trust their successes. They are constantly afraid of being exposed as a fraud, no matter how much they've accomplished. "I just got lucky," they might say. As much as they want a higher level of responsibility or a specific promotion, deep down they question whether they are good enough to get it.

Then, there are other leaders like my client, George, who allowed a setback to damage his confidence. He had 29 years of experience in the corporate world. For 27 of those years, he was a dynamic go-getter, moving up the ladder and achieving great success every step of the way-not just in his professional life, but in his personal life as well. For the last two years, though, things hadn't gone so well for him.

He had taken over a division that was new to him, and it wasn't performing well under his leadership. When we met, I could sense George's energy. He was like a balloon that had been deflated.

"George, for how many years did you have tremendous success?" I asked him.

"Twenty-seven years," he responded.

"And for how long have things been a bit rocky?"

"These past two years," George replied.

"So, you've had 27 years of positive, ongoing successes, and only two years-24 months-of less-than-positive outcomes. Is that correct?"

I could see the realization of this sinking in. "You're right-I have to keep that in perspective," George said. "I can't let these past 24 months cloud a career and a life that has gone so well. It's only a small portion of the whole."

George is an example of how quickly confidence can fade if we're not careful to nurture it. And once confidence fades, Executive Presence takes a hit.

Keep Your Confidence Level Steady

If you take an inventory of your successes and how they came about, you'll most likely recognize that it was definitely not "all luck." Your talents, skills, and hard work are why you've achieved success.

Here's an exercise to help you look honestly at what you have done and the skills you've developed, while acknowledging what you believe you genuinely lack. Make two columns on a legal pad or on your computer, and on the left-side column, list your most valuable attributes. Don't stop adding to the list until you've run out of qualities and skills (and don't be humble!)

Then, in the right column, list the areas where you still need work. Be objective about what you could do better. Once done, sit back and review the two lists. If you're like most of my clients, I suspect you'll be surprised at the outcome, because we often underestimate what we can do versus what we think we cannot do. (I assigned George this exercise, and this one task alone gave him more momentum than he'd had in a long while.)

It's critical to look at yourself the way others do, but it's difficult to see yourself through an objective lens. That's why it's so important to getting meaningful feedback-and why I devoted an entire chapter to that topic in my book, Leading YOU™: The power of Self-Leadership to build your executive brand and drive career success.

The single most powerful and productive exercise I give my clients is the task of keeping a "Confidence Journal." It's simple: As you go through your day, and you have an experience that either increases or decreases your confidence level, write down what happened and why. Whether you are being challenged by a peer, find yourself on the receiving end of a compliment from the CEO, needing to fire someone, or struggling to influence outcomes, make sure to remain objective, and ask yourself: "What's happening to my confidence right now?" Go inside and figure out how the experience is impacting you. What's the context? Who's involved, and what's triggering the "boost" or the "bust"? What's really causing those ups and downs?

Jot every incident down, and give your confidence level a score based on how you feel: 1 = Not feeling confident at all, 10 = Feeling fully confident. Don't judge yourself as you write-just be objective. Detach emotionally for a moment, and become an impartial reporter of what's happening inside you, noting what triggered your shift in confidence.

Depending upon how many incidences you have, after a week or two of keeping track, pick up your confidence journal, and look for trends. What do you see, objectively? For example, it might be that your confidence level drops when you address very senior leadership, but you feel fully confident when addressing and leading direct reports.

Or maybe you wrote: "When I'm dealing with peers over whom I have no direct authority, my confidence level drops."

Or: "When I'm involved in a conversation in my area of expertise, my confidence is high, but when I'm called upon to discuss areas outside my division, my confidence is reduced."

Some clients keep the journal for two or three weeks, while others like to keep it going for two months or longer. It's up to you. Once you understand the triggers that are causing confidence highs and lows, you'll then be better able to preempt the triggers so that you can avoid confidence dips.

If you strengthen your Executive Presence in this way, you'll be much less likely to allow a setback to diminish your belief in yourself. Keep in mind all of your achievements, and use them to keep you moving forward, even when faced with a challenging situation. You may be asking yourself, what in the world is BADD and do I have it. I came up with the phrase after thinking about what could be wrong with me. I can never seem to focus on one business opportunity at a time. After thinking about it I came up with the name Business Attention Deficit Disorder or BADD.

One of my daily chores was glancing through the classified ads for business opportunities. Even though I already had a business I worked from at home I still had this uncontrollable urge to look for something bigger and better. As far back as I can remember this has always been a problem for me. If I find a business I like and start working it, I always give up if I don't make a bunch of money in a couple of weeks. In fact it is so bad that people who know me ask, what business are you working this week Mark.

Looking through classified ads and clicking on links that takes me to a new opportunity got my blood pumping. I know it was killing my financial life but it takes over me like a ghost controlling my every move. I even did a little research to see if other people have the same problem as me. Much to my surprise, there were thousands of people who have the same trouble focusing on one thing at a time. Do we call them multi taskers or do they just lack the ability to focus on 1 thing at a time

I went back through the favorites bar on my computer and started clicking old links I had saved. 3 out of every 5 links I clicked on was a dead end link. You know what was really crazy about the these links, they were less than a year old. That means most people don't give anything a chance to build up before they try something else.

My research took me to the search engines for an experiment. I did a search for a popular search term and started clicking on the organic results. I went back a couple of pages on the search results just to get an idea of how many dead links there were. Did you know there were people who had their websites listed on page 1 and 2 who were no longer active on their websites. Do you know how much money they could be making if they just stuck around a little while longer.

This experiment got me thinking about how I should approach being an entrepreneur. If you are going to be successful at anything you have to stick with it no matter how long it takes. You could close your shop tomorrow and the day after that your biggest client could come along. I found out the hard way that all those new opportunities were all the same. The promise of big money in a short time. Success takes time and patience.

Take the time and plan your business and set budgets and goals. Do some research and find out who your customers are and how to get them to visit your website or store. If you are an affiliate for a product, don't use the company cookie cutter website to get customers. Send them to a page you made or someone else made for you. I use a lead capture page and give them something of value.

Yes, international factories can produce parts inexpensively, but at what cost to global business?

The consumer is the main reason that businesses become successful. Without the consumer, companies would be wasting precious resources and capital to produce products or services that are not purchased. People around the world have become so mesmerized with Apple products that they spend outrageous amounts of money on them. The cost of these products does not change despite the country it is being sold in. However, if the consumer cannot afford the product, they cannot buy the product. Competing companies are also affected by globalization of technology. For example, when Company One sends the manufacturing of their products abroad, there are many negative impacts on similar businesses. There are missed sales opportunities for other companies because Company One is able to sell their product for significantly less due to domination in the market in consumer interest. The consumer seeks cheaper items with available supply. The supply tends to be greater because larger manufacturers can supply more product for less, driving the demand up even more. Finally, the most important point about globalization would be the long-term effects on global business. Higher profits may be seen initially, but overall, globalization affects the consumer and all countries involved so much that sales volume will likely decrease as time passes. This blatantly cancels out the main goal of globalization for a company in the first place.
